PERSONAL DATA PROTECTION AND PROCESSING POLICY

INTRODUCTION AND PURPOSE

This Personal Data Protection and Processing Policy ("Policy") has been prepared by CreaFikir Software & Advertising Agency ("Company" or "Agency") in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data ("KVKK") and related legislation, to determine the procedures and principles regarding the processing, storage, transfer and protection of personal data.

  1. DEFINITIONS

Personal Data: Refers to any information relating to an identified or identifiable natural person.

Special Category Personal Data: Refers to data relating to a person's race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and clothing, membership in associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data.

Data Controller: Refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system, i.e., CreaFikir Software & Advertising Agency.

Data Processor: Refers to the natural or legal person who processes personal data on behalf of the data controller, based on the authority given by the data controller.

Data Subject: Refers to the natural person whose personal data is being processed.

Explicit Consent: Refers to consent given freely and based on informed knowledge regarding a specific matter.

PURPOSES OF PROCESSING PERSONAL DATA

CreaFikir Software & Advertising Agency processes personal data for the following purposes:

  • Identity Information: Name, surname, Turkish Republic Identity Number (where necessary), date of birth

  • Contact Information: Phone number, email address, address information

  • Customer Transaction Information: Requested services, project details, preferences and likes

  • Financial Information: Bank account information, invoice information, payment history

  • Transaction Security Information: IP address, cookie records, log records

  • Marketing Information: Interests, purchasing habits, campaign preferences

  • Identity Information: Name, surname, Turkish Republic Identity Number - Identity number, place and date of birth, marital status

  • Personal Information: Social Security number, tax number, education information, certificates

  • Performance and Career Information: Performance evaluation results, career plan

  • Financial Information: Salary, bank account information, Social Security contributions

  • Health Information: Health reports obtained within the scope of occupational health and safety (special categories)

  • Visual and Audio Recordings: Photographs, security camera recordings

4.3. Business Partners, Suppliers and Service Providers

Personal Data Processed:

  • Identity and Contact Information

  • Authorized person information

  • Contract and financial information

  • Other information shared within the scope of the business relationship

4.4. Visitors

Personal Data Processed:

  • Identity Information: Name, surname

  • Contact Information: Phone, email

  • Visit log information

  • Security camera recordings


5. CONDITIONS FOR PROCESSING PERSONAL DATA

CreaFikir Software & Advertising Agency processes personal data based on the following legal grounds specified in Articles 5 and 6 of the KVKK (Personal Data Protection Law):

a) The explicit consent of the data subject,
b) It is explicitly provided for in the laws,
c) It is necessary for the protection of the life or physical integrity of the person who is unable to express their consent due to factual impossibility or whose consent is not legally valid, or for the protection of the life or physical integrity of another person,
d) It is directly related to the establishment or performance of a contract, provided that it is provided to the parties of the contract.
